An advance directive is a way for service users to make their views known before a crisis, when they may be unable to make informed choices. Their views regarding their mental health care, expressed and documented when they are mentally capable, can be taken into account if and when they become mentally incapable of giving consent or making informed choices.

Legal Rights of Informal Patients Flyer
An informal patient is someone who is not detained under the 1983 Mental Health Act. If someone has been admitted for medical treatment for their mental health problem as an informal patient, they have the same rights as someone who goes into hospital for a physical reason. Patients who are detained under the Mental Health Act 1983 are sometimes known as "formal" patients. Formal patients have different rights.
